View submission: Elon Musk misleadingly suggests other celebrities made controversial 'Nazi' gesture
I’m not sure about that. Just my guess, but I reckon a charge would only occur if the salute occurred in a context that made the meaning clear. Like an aggressive mob in the street chanting or something. Elon The Idiot made his motion without any real context as far as I know. All thinking people criticise him for it, but it’s hard to say an arm motion by itself should be a criminal offence.
Just a troll. And taking attention away from other hideous things like pardoning Jan 6 aggressors.

Let’s consider the profile. Former South African, wealthy apartheid family, has literally come out in support of ultra right wing groups globally. Aligned media ownership to promote these ideals. He’s a Nazi, snapping out the 10:30 salute with the well practiced moves of a teen edge lord.

The context makes even worse. It was a major political stage and he saluted the flag/leader.
