~~dacvak(i think?)~~deimorz said the thumbnails can't truly be disabled.

EDIT: Actually I think it was deimorz who said it.

EDIIT: it was deimorz

Yeah... is the thumbnail image really the crux of this whole thing? And is this obvious solution not an option?

No one knows if ANY dcma takedown notices were actually sent. No proof has been offered.

In light of this lack of proof the only reasonable supposition is the subreddit was banned because powerful people wanted it banned.

But I believe in the good will of the mods. They can easily post copies if the dcma takedown notices from the lawyers. Clean, unredacted copies.

There is no expectation of privacy in any law anywhere about the notices. The mods are fully within the law by posting the notices. And if they are posted that will prove the good will of the mods.

I'm not sure I understand this part. So reddit was liable to DMCAs because it was hosting the thumbnail image of the copyrighted pictures?

That's what he said.

Here's what Wikipedia says about linking:

The law is currently unsettled with regard to websites that contain links to infringing material; however, there have been a few lower-court decisions which have ruled against linking in some narrowly prescribed circumstances. One is when the owner of a website has already been issued an injunction against posting infringing material on their website and then links to the same material in an attempt to circumvent the injunction. Another area involves linking to software or devices which are designed to circumvent (digital rights management) devices, or links from websites whose sole purpose is to circumvent copyright protection by linking to copyrighted material.
     .

Couldn't you just disable thumbnails for /r/thefappening or something?

Others have asked this, including me, but I haven't seen it answered. It seems like a sensible solution. Once they have the code written to make an exception for one sub, they could use it to make exceptions for other questionable subs as well.

I also don't understand why they were so "exhausted" with all the activity. Aren't DMCA takedowns automated like on Youtube? They should have to do anything manually, so why is there extra effort involved in these cases?

It was the pictures of minors that were causing the issue. The links to those have to be removed which results in a ton of reposts.

Think of it like the mythical Hydra. When you take one link down, two more appear.

If they just delete the thumbnails and the internet police start asking for user's info who are linking and spreading things which have been deemed illegal by the powers that be, would you want them to have to give the info under subpoena, or just ban the subreddit entirely?

I had huge respect for this site after I saw them put freedom over laws.

Well that was short lived. I didnt visit the fappening, but it was a force of internet freedom that seemed to be lacking.

What? A way to satisfy both the legal requirement AND give users a free speech platform?

I thought they just made a blog post and this announcement to say such a thing wasn't possible?

Stop making sense. This is probably the one post that they won't reply to, because it completely invalidates their reasoning.

Web programmer here: yes not loading thumbnails would be really easy. It's a simple css change on the custom subreddit page. There were alternatives but when you don't like the subreddit anyways why try?

I think its pretty obvious this was done to please some celebs. They even say it wasn't. What clearer admission could you ask for from conde nast?

DMCA requires that links to copyrighted images must also be removed.

I guess you could start /r/TheFappening2 and set it in text submissions only. Then deal with the CP like any other subreddit.

Problem solved.

Remember, linking to illegal content is still illegal in the eyes of the law.

I don't agree with this stance and it puts reddit in a difficult situation, but that's how it is.

You're not allowed to link to DCMA'd content either. It isn't just thumbnails.

when you submit a link to reddit it makes a little thumbnail which is stored in it's server to show others.
