Step 6 ā€“ Shared care

Finally, we take into account ā€˜shared careā€™.

This is when a child who qualifies for child maintenance stays overnight

with the paying parent on average at least one night a week.

We ask both parents to give us formal, informal or spoken evidence

of any agreement they have reached about shared care. We will also

accept a court order setting out shared care details.

If we accept that there is shared care, the weekly amount of child

maintenance worked out in Step 5 may be reduced.

How we work this out

The reduction for shared care works differently depending on the child

maintenance rate which we worked out in Step 5.

Basic, Basic Plus or Reduced rate

The paying parentā€™s weekly amount of child maintenance at

Step 5 is divided between the number of children they must pay child

maintenance for.

We then take shared care into account, based on the number of nights

of shared care for each child.

The more nights that the child or children stay overnight with the paying

parent, the more we take off the weekly amount of child maintenance:

We donā€™t need to know about every change to the number of nights of

agreed shared care.

We only need to know if the change affects the ā€˜shared care bandā€™ used

to work out the reduction.

This means that if the number of nights of shared care a year changes

from 140 to 150 we would not need to know.

But if the number of nights of shared care a year changes from 150 to

160, this change would need to be reported to us by either parent.

Shared care example

Mark has two children that he pays child maintenance for (David

and Sarah). He also has two receiving parents in his case group.

Weā€™ve worked out that his weekly amount of child maintenance

before shared care is Ā£22.50.

Mark has overnight care of David for 54 nights a year.

We divide Ā£22.50 between Markā€™s two children. This works out at

Ā£11.25 for each child.

We then reduce the amount of child maintenance Mark pays each

week for David by 1/7th (Ā£1.61).

This means Mark pays Ā£20.89 in child maintenance each week after

shared care for David is taken into account.

Sarah receives Ā£11.25 and David receives Ā£9.64.

The content of the examples in this leaflet is for illustrative purposes only.

If child maintenance is set at Basic, Basic Plus or Reduced rate, a paying

parent will always pay at least Ā£7ā€ 

a week in child maintenance after

shared care has been taken into account. Even allowing for shared care,

their weekly payment canā€™t fall below this amount.

What does this mean?

The whole of the family law system encourages abusive parents, such as my former wife, to deny contact between their victim and their children, for financial reasons in addition to "pure, unadulterated spite". It is more profitable financially for the abuser to prevent contact. And if the "paying parent" loses their home as a result, they cannot have overnight contact!

This but one example of how UK family law, aids and abets continued abuse of their former victim, discourages them from from leaving an abusive situation, makes it harder for the victim to escape poverty and prevents child contact between the victim and the paying parent who did nothing "wrong" - other when seek to leave the abusive situation.

It is also, a golden, shining example, of how UK family ls an abusers charter.

And of course, it also prevents the "paying parent" from being a 'good parent' by spending money on the children directly - in such a way the abuser cannot spend the the victimā€™s money of their own lifestyle.

I told my own daughters, last New Years' eve, how I paid onto my daughter's trust fund accounts every new years' eve in the 'olden days' - but due to the actions of their other, I have been unable to do so since the breakup. When will the imbeciles who run this country get some hard tuition in reality?
