Let’s assume you’re looking for a new service provider on internet. What to look for? Despite all the differences between servers, software and platforms, there are some issues in common. I would like to address these privacy-related questions.
Who owns it? What is his/her reputation and experience in the field? Is a company’s leadership team a public information?
Does it exist? How transparent is it? Is something missing or ambiguous? If you ask a question about the policy, do they answer?
Is the server located in privacy-friendly jurisdiction? City, county, state laws? Is that jurisdiction a part of governmental surveillance program?
Is the area known for earthquakes, hurricanes or other environmental risks?
Is it privacy by design? If not, has the service provider explained why possibly unnecessary features exist?
If service provider is contacted by law enforcement with court order, are they transparent about it? What about if law enforcement from a foreign land asks information about the users?
Is it easy to request personal data deletion? Or is it even possible?
Can you opt-out from data collection?
If your data is handled to third parties, who are they? Is it a secret (and why)? What kind of privacy policy and security measures do they have?
In case you and your service provider end up in a court, the court location may be mentioned in documents such as License Agreement, Terms of Service (TOS) or Terms of Use (TOU).
Of course, there are more questions to be raised, but this is a good start anyway.
