Hi all

I’m wondering if anyone can comment on whether there are a lot of lawsuits for personal injury in North Carolina? I work in the OB/GYN speciality and am coming from northern Nj where it seems like patients threaten to (and successfully do) sue for complications related to labor and delivery and other health-related complications frequently. It feels so common that it often guides our practice unfortunately.

Not looking for disparagement of medical providers or whether the care they provide is good or not. I’m just curious if there are fewer lawsuits in NC than in NJ. Thanks

This seems like a question you could call up local hospitals to find out. But you can expect lawsuits no matter what state you're in, and it does largely depend on the quality of care. Sorry not sorry.

Some recent examples in NC:

In 2018, A mother sued an obstetrician and hospital after her son suffered permanent brain injuries due to a delayed C-section. The case settled for $2 million

In 2022, An OB-GYN practice in Raleigh agreed to pay $385,000 to settle allegations that the practice submitted false claims to Medicaid

To date, the largest settlement in the state was $10.75 million because doctor and hospital negligence led to the newborn suffering Severe hypoxic-ischemic brain injury, resulting in cerebral palsy
